Terms of Service

1. Agreement

By accessing or using Animyx ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. Animyx ("we," "us," or "our") reserves the right to modify these Terms at any time; continued use after changes constitutes acceptance.

2. Description of Service

Animyx provides an AI-powered platform for generating pixel sprite characters and animations. You can create sprites from text prompts, generate idle, walk, and jump animations, and export spritesheets for game engines such as Godot, Unity, and Phaser.

3. Account and Eligibility

You must create an account to use certain features. You represent that you are at least 13 years old and have the legal capacity to enter into these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Credits and Payment

Our service operates on a credit-based system. Credits are consumed when you generate sprites, create animations, or use certain features. You may receive free credits or purchase credits/subscriptions. Paid plans are billed through Stripe. Refunds are handled according to our refund policy and applicable law. Unused credits may not roll over depending on your plan.

5. Acceptable Use

You agree not to:

  • Use the Service to create content that is illegal, harmful, defamatory, harassing, obscene, or infringes intellectual property rights
  • Submit prompts designed to generate content depicting real individuals without consent, or minors in any inappropriate context
  • Attempt to circumvent credit limits, rate limits, or security measures
  • Resell or commercially redistribute the Service without permission
  • Reverse engineer, scrape, or automate access to the Service
  • Use the Service in any way that could harm, disable, or overload it

We may suspend or terminate your account for violations of this section.

6. Intellectual Property

Your Content

You retain ownership of prompts you submit and sprites you generate. By using the Service, you grant us a limited license to process, store, and serve your content solely to provide the Service to you.

Our Service

Animyx, including its software, design, branding, and documentation, is owned by us and protected by intellectual property laws. You may not copy, modify, or create derivative works without our written permission.

7. AI-Generated Content

Sprites and animations are generated by AI models. We do not guarantee accuracy, quality, or suitability for any particular use. Output may vary. You are responsible for reviewing generated content before use and ensuring it meets your needs and does not infringe third-party rights.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANIMYX AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify and hold harmless Animyx and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms or any law.

11. Termination

You may close your account at any time. We may suspend or terminate your account for violation of these Terms, non-payment, or at our discretion. Upon termination, your right to use the Service ceases. We may retain your data as described in our Privacy Policy.

12. Governing Law

These Terms shall be governed by the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction.

13. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right does not waive that right. These Terms constitute the entire agreement between you and Animyx regarding the Service.
